Article 1 - Applicability

1. These terms and conditions apply to every offer from KoffiePiraat and any agreement reached between remote KoffiePiraat and buyer. Purchasing conditions or other forms of buying conditions that a customer might have will not be accepted by KoffiePiraat. In the event of a dispute between KoffiePiraat and a client, Dutch law, in that case, is applicable.

2. Acceptance of an offer or conclusion of a contract is only possible after acceptance of these terms and conditions.

Article 2 - Offers and agreements

1. Offers from KoffiePiraat are free to change and based on the current prices of that time.

2. KoffiePiraat strives to offer as complete a description as possible, to give the client full information on the products offered. In the case of using graphics/images KoffiePiraat strives to use a true representation. Obvious mistakes or errors in the KoffiePiraat offer are not binding.

3. The contract is concluded at the moment of acceptance by the recipient of the offer and meeting the corresponding conditions.

4. If the client has accepted the offer electronically, KoffiePiraat receives immediate electronic receipt of acceptance of the offer. Until receipt of this acceptance has not been confirmed, the consumer may rescind the contract.

5. KoffiePiraat can ensure that clients can fulfill their payment obligations, as well as all facts and factors that are important to a sound conclusion involved with an internet purchase. If this investigation justifies KoffiePiraat not to act in the agreement, KoffiePiraat is entitled to a refuse the order or request or to proceed under special conditions. In case of refusal of an order, KoffiePiraat will notify the buyer within two weeks.

Article 3 - The price

1. Our prices will be disclosed in euros, including Dutch VAT (Tax) and excluding the cost of shipping, unless otherwise agreed.

2. The obligation and responsibility to handle any kind of any fees, taxes and surcharges related to delivery in any country other than the Netherlands lies with the buyer.

* Please be advised that you are responsible for reporting and paying the coffee tax, should that be required in your country. Countries with coffee tax include, but are not limited to: Germany, Belgium and Denmark.

In Belgium you must report your import(within 1 week) here: Federale Overheidsdienst Douane en Accijnzen

Please consult with your with your local customs, about import taxes.

3. All prices are subject to obvious typographical errors.

4. KoffiePiraat reserves the right to change prices at any time if necessary. Cancellation of the contract by the customer is possible until the effective date of price changes.

Article 4 - Payments

1. Payment only via the payment methods listed on the website, unless otherwise agreed.

2. The buyer has the duty to inaccuracies in the supplied or specified payment immediately to KoffiePiraat register.

3. KoffiePiraat remains the owner of the ordered goods until delivered, and until full payment has been made by the customer.

4. KoffiePiraat has the right to charge the customer reasonable costs in case KoffiePiraat is faced with extra costs because of payment issues caused by the buyer.

Article 5 - Delivery

1. KoffiePiraat uses a third party for the shipment of the ordered goods. The buyer is notified about the fee involved for the shipping during the ordering process.

2. KoffiePiraat strives to offer the ordered goods to the carrier within 3 days. If delivery of the ordered goods to the carrier for shipment is not possible within these 3 days, you will be notified.

3. If it appears that delivery of goods ordered will be more than 14 days, the buyer has the right to terminate the contract and obtain a refund of any amounts already paid for goods ordered.

4. Unless otherwise agreed, delivery will be made to the delivery address specified by the customer. In case a package cannot be delivered, it will be returned to our warehouse. KoffiePiraat will refund the purchase price of the goods reduced with the costs of shipping the goods back to our warehouse. In case of shipment to a Pickup parcelshop, packages need to be picked up within 5 days. If not picked up within 5 days, the items will be shipped back to our warehouse and above costs apply.

5. All goods are inspected by KoffiePiraat before shipment. If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.

Article 6 - Right to cancel

You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right to cancel, you must inform us via mail at [email protected] of your decision to cancel this contract by a clear statement per e-mail. Please use the retourn form with your return. This will expidite processing of your return and ensure that we know from which client we have receved the return, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Excluded from the right to cancel is a consumer purchase that involves the delivery of:

- products that spoil quickly or have a limited shelf life;

- products that are not suitable to be returned for reasons of health protection or hygiene and whose seal has been broken after delivery;

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you any goods supplied.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

We will withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Article 7 - Returns

1. When purchasing products, the customer can cancel the contract without giving any reason to cancel within fourteen calendar days. This period starts on the day following receipt of the product by or on behalf of the customer.

2. During this inspection period, the buyer has a right of withdrawal, where the customer without reason has the right to return the unopened and undamaged packaging, at the cost of returning.

3. Koffiepiraat accepts returns only on products returned unopened and in undamaged packaging and only after prior notification and agreement by Koffie Piraat.

Excluded from the right to cancel is a consumer purchase that involves the delivery of:

- products that spoil quickly or have a limited shelf life;

-products that are not suitable to be returned for reasons of health protection or hygiene and whose seal has been broken after delivery;

Article 8 - Liability

1. Despite great care in compiling the content of the website KoffiePiraat is not liable for any inaccuracies and their consequences.

2. KoffiePiraat is not liable for any damage caused by (incorrect) use of purchased products.
